Законно ли использование чужой банковской карты?

Каждая банковская карта является персональной и может принадлежать только одному конкретному человеку. На обратной стороне пластика наноситься надпись о данных владельца, стоит его подпись. Но, на практике нередко картой пользуются несколько человек. Такие ситуации уже не редкость, когда жена приходит в торговую точку и расплачивается кредиткой мужа или сын пользуется картой матери. Основной вопрос, который необходимо рассмотреть связанный с тем, насколько оплата чужой банковской картой законна и какие предусмотрены наказания.

Использование карты с согласия владельца

Закон достаточно лояльно относиться к тем, кто пользуется чужой банковской картой с согласия владельца. Если не был причинен ущерб, ответственность зачастую не предусматривается. Но, необходимо помнить о том, что в качестве потерпевшей стороны может выступить не держатель карты, а компания, которая ее выдала. Существует метод, с помощью которого можно легализировать доступ к карте третьим лицам. С такой целью осуществляется выпуск дополнительного «пластика», которым может распоряжаться конкретный человек.

Использование карты без согласия владельца

Подписывая договор с банком, при оформлении карты клиент принимает некоторые правила, соблюдение которых необходимо. Если была осуществлена оплата чужой картой, сторонние лица узнали ПИН-код или другую важную информацию, владельцу необходимо выполнить следующие действия:

  • Любым доступным способом сообщить о проблеме банковскому сотруднику (прийти в отделение, связаться через официальный сайт, позвонить по номеру горячей линии);
  • С помощью специальных приложений, звонка, посещения представительства банка заблокировать карту.

Если клиент не соблюдает условий пользования банковскими продуктами, финансовая организация вправе самостоятельно заблокировать карту, предпринять меры по ее изъятию, прекратить возможность осуществлять какие-либо операции.

Оплата чужой картой в интернете или другом месте и ответственность за совершенное преступление описана в Федеральном Законе №207-Ф3, в статье 159.3 «Мошеннические действия с использованием поддельной карты вследствие обманных схем». Закон определяет виновных, если человек:

  • Ввел в заблуждение держателя карты, завладев ею;
  • Занимался производством карты или подделал данные реального клиента, что привело к завладению ценными данными и возможностью распоряжаться «пластиком»;
  • Похитил финансы с другой кредитки.

Согласно статье статье 159.3 «Мошеннические действия с использованием поддельной карты вследствие обманных схем» судьей в ходе разбирательств, определения всех составляющих совершенного преступления, может быть вынесен один из ниже перечисленных приговоров:

  • Ограничение свободы до двух лет;
  • Штрафные санкции – максимум 120 000 р.;
  • Исправительные работы до одного года;
  • Заработок злоумышленника за последние 12 месяцев;
  • Обязательные работы периодом максимум в 360 часов;
  • Арест – до четырех месяцев.

Владелец карты всегда сможет защитить свои интересы, если сообщит о неприятном инциденте банк как можно раньше и предоставит суду необходимые доказательства.
