При получении кредита заемщик сталкивается с тем, что приходится оплачивать не только займ, но и страховку по нему. Часто банки принудительно оформляют полис, не предупреждая потребителя. Не стоит отчаиваться: услуга является добровольной. Более того, затраченные средства можно вернуть.
Что такое страховка и зачем она нужна
Заемщики думают, что потребительский кредит нельзя оформить без страховки. Это не так, согласно закону – процедура не является принудительной.
Есть ошибочное мнение, что страховка дает что-то клиенту. Например, страхует его от несчастных случаев, потери трудоспособности и т.д. На самом деле страховка – это гарантия для банка, что он получит назад свои средства. Если заемщик по какой-то причине не сможет выплачивать деньги ( инвалидность, потеря работы и др.), то страховая компания (СК) берет на себя финансовые обязательства.
В каких случаях можно вернуть страховку
Для начала отметим, что не всегда потребитель финансовых услуг имеет право настаивать на возвращении средств. Под запрет попадают:
- Кредиты на жилплощадь. Страхование имущества при ипотеки – обязательный атрибут;
- Страхование автогражданской ответственности;
- Автокредиты (обязательно подлежат страхованию по системе КАСКО).
Страховку можно назвать «навязанной», если оформлялись:
- Кредиты на приобретение товаров, т.е. потребительские займы;
- Кредитная карта;
- Другие виды займов.
Период охлаждения – срок, при котором можно вернуть средства по страхованию. Ранее срок ограничивался 5 днями. С января 2018 год он составил 14 дней. В течение этих двух недель после заключения договора клиент может подать заявление и вернуть страховку.
С чего начать?
Несмотря на то, что страхование навязывается кредитными организациями, по поводу нее необходимо обращаться непосредственно в страховую компанию.
- Сначала пишется заявление страховщикам в произвольной форме. Особых требований по заполнению документа нет, но лучше написать его в присутствии сотрудника;
- Бумаги в 2-х экземплярах направляются в компанию лично или через почту. В заявлении обязательно указываются полные банковские реквизиты, куда будут перечисляться деньги;
- При положительном решении деньги поступят по указанным реквизитам в течение 10 дней.
Обратите внимание: процесс возвращения необходимо начинать в «период охлаждения», позже это сделать практически нереально.
Возврат при досрочном погашении – часто встречающееся явление. Клиент стремиться вернуть неиспользованную часть страховки. Сделать это довольно просто. Нужно прийти в банк и взять справку о досрочном погашении, направить документы в СК.
Нюансы и заключение
Некоторые банки идут навстречу заемщикам и предлагают более лояльные условия. Например, в Сбербанке можно отказаться от добровольного страхования в течение 1 месяца.
ВТБ 24 также идет на уступки по страхованию. Возврат денег можно произвести в течение 30 дней. Другие банки работают только с установленными законом сроками.
Вернуть страховку можно достаточно просто, если соблюдать законодательство. В некоторых случаях возникают споры, которые заканчиваются судом. В этой ситуации следует позаботиться о квалифицированной юридической помощи.
