Банки требуют обоснований экономического смысла денежных переводов даже при сумме менее 1000 рублей, сообщается в газете «Известия». Информация поступила от клиентов Банка Тинькофф, Сбербанка, Бинбанка. В случае отказа от предоставления поясняющих документов карты граждан блокируют.
Когда Сбербанк может заблокировать карту при переводе?
«Известия» напоминают гражданам о рекомендациях по обращению в ЦБ РФ через интернет-приемную в случае необоснованной блокировки переводов. Регулятор поясняет, что банк приостанавливает транзакцию при подозрениях на распоряжение деньгами посторонним лицом без согласия законного владельца средств. Финансовое учреждение обязано удостовериться в желании клиента совершить перевод. При этом излишни требования по объяснению назначения платежа и происхождения суммы.

Представители Сбербанка заявили об отсутствии необоснованного контроля переводов. Действующая система проверок направлена на защиту пользователей от мошеннических действий.
Согласно ФЗ № 115 денежные переводы подлежат анализу для выявления подозрительных транзакций. Отслеживаются безналичные поступления с последующим снятием наличных, имеющие признаки незаконного оборота. Банк блокирует нелегальные переводы, связанные с финансированием запрещенной законом деятельности.
Действия Сбербанка при выявлении подозрительных транзакций
Служба финансового мониторинга ведет реестр нарушителей. Банкам запрещено обслуживание лиц, попавших в черный список. Перечень неблагонадежных клиентов неуклонно расширяется. В случае обнаружения подозрительной транзакции Сбербанк вправе:
• заблокировать карточку;
• запретить использование дебетового счета;
• отказать в транзакции, выдаче денег наличными;
• закрыть для клиента сервис онлайн обслуживания.
Если карту заблокировали при поступлении крупного перевода, придется доказать законность происхождения суммы, предъявить соответствующие документы (договор купли-продажи машины, расписку в получении частного займа). Банк уведомляет клиента в СМС, по телефону или сообщением на электронную почту о возможной блокировке карточки, одновременно запрашивает документацию и объяснения. Сроки рассмотрения дела и снятия блокировки также указываются в уведомлениях.
Распространено мнение о том, что при невозможности подтвердить законность перевода клиент безвозвратно утрачивает деньги. Пресс-служба Сбербанка указывает на противоречие основам банковской деятельности полного отказа в выдаче денег клиенту. Блокируется не счет пользователя, а подозрительный перевод. После двукратного отказа в выполнении операции договор с клиентом расторгается. Деньги при этом перечисляются на счет пользователя в другом учреждении.
Блокировка карт граждан за переводы
Критерии сомнительных транзакций определены Положением ЦБ РФ от 02.03.2912 г. №375-П. Подозрения вызывают операции, имеющие признаки:
• неправомерного обналичивания денег;
• расчетов по запутанным схемам;
• сокрытия истинных целей участников сделки;
• незаконного вывода средств за границу.
При обоснованных сомнениях в легальности финансовой операции кредитная организация принимает упреждающие меры.
Как избежать блокировки карты?
Желающим избежать подозрений, ведущих к блокировке карты, следует соблюдать простые правила:
• отказывать в просьбах родственников, знакомых о переводе денег, не принадлежащих владельцу счета;
• не снимать средства, поступившие из неизвестного источника, уведомить банк о таком поступлении;
• никому не сообщать реквизиты карточки, чтобы предотвратить незаконное обналичивание или транзит;
• пользоваться безналичными расчетами, снимать деньги в банкомате при крайней необходимости;
• не оформляться в качестве фиктивного директора фирмы или ИП без реального участия в ведении бизнеса;
• не применять карты физлица для операций, связанных с деятельностью предпринимателя;
• для расчетов ИП с контрагентами открыть бизнес-карту;
• обеспечить документальное подтверждение своих финансовых операций, сохранять договора, квитанции;
• отвечать на запросы о подтверждении законности денежных операций, сотрудничать с банком;
• в установленные сроки представлять объяснения экономического смысла конкретной транзакции.
В случае блокировки перевода между картами следует немедленно обратиться к эмитенту любым из доступных способов:
• лично посетить офис;
• позвонить в службу поддержки;
• подать дистанционное обращение на официальном сайте учреждения.
Соблюдение мер предосторожности позволяет избежать неприятностей при применении банковской карты.
